2.1 The
following categories of goods are available for sale via the
Aliya Rose website, www.aliyarose.co.uk:
- Tiaras
- Jewellery
(necklaces, earrings, bracelets)
- Hair
accessories
- Veils
- Shoes
- Petticoats
- Garters
- Hair
Diamonds
- Foot
Petals
2.2 It
should be noted that as items are sourced from external supplier's
delivery can take up to 6 weeks, refer to paragraph 4.2 for
more details.
3.
Payment
3.1 Full
payment is required before any items ordered will be delivered.
The following methods are accepted as means of payment:

" Cheque, made payable to Aliya Rose Ltd, sent to 18

4.
Delivery arrangements
4.1 All
items will be delivered in accordance with the delivery instructions
and postage method given by the customer via the online ordering
facility. Whilst every attempt is made to ensure delivery
within a timely fashion due to external influences this may
not be possible in all circumstances.
4.2 Different items sold by Aliya Rose Ltd are subject to
different delivery times and every attempt will be made to
distribute goods promptly. However, customers should note
that the following items may take up to a period of 6 weeks
to arrive in store before they can be distributed accordingly:
- Carousel
tiaras
- Veils
- Shoes
4.3 Aliya
Rose Ltd does not accept liability for any external factors,
such as postal strikes or busy postal periods such as Christmas,
that affect the ability to deliver goods or the length of
time it takes for goods to arrive.
5.
Right to cancel
5.1 All
consumers have the right to cancel their contract with Aliya
Rose Ltd within 7 working days (therefore excluding Saturdays,
Sundays and Public holidays) of receipt of goods. In order
to exercise their right to cancel customers MUST notify Aliya
Rose Ltd within the 7 days in writing, by letter, email or
fax. Failure to notify Aliya Rose Ltd within this time limit
will result in the customer losing their right to cancel their
contract.
5.2 The
right to cancel to does not extend to all items; In accordance
with s.13(c) of The Consumer Protection (Distance Selling)
Regulations 2000 goods that have been made to the customers
specifications, have been personalised or which by reason
of their nature cannot be returned. Aliya Rose Ltd does not
accept return on the following items:
- Veils
- Earrings
- Dyed
shoes
5.3 The
statutory right to cancel is not applicable where a customer
has previously viewed the items purchased in store before
purchasing online. In this situation the statutory rights
afforded to a customer under the Sale of Goods Act 1979 apply.
6.
Returns
6.1 All
customers are under a statutory duty to take reasonable care
of any goods that they intend to return to Aliya Rose Ltd.
Where goods are not being returned on the basis of quality,
goods should be returned in a reasonable, re-saleable condition
and in original packaging where possible.
6.2 Aliya
Rose Ltd reserves the right to take any necessary action to
recover both the cost of any item(s) returned and all associated
expenses where it is deemed that the condition of those item(s)
returned, for reasons other than quality, to be wholly unacceptable.
6.3 Customers
returning items should do so within a timely fashion (within
30 days). Failure to return items will result in Aliya Rose
Ltd taking action to recover the cost of the item(s) and all
associated expenses.
6.4 The
cost of returning an item to Aliya Rose Ltd will be borne
by the customer. All items returned to Aliya Rose Ltd should
be appropriately packed to ensure safe transit and the appropriate
level of postage and insurance taken (therefore sent via the
same method as Aliya Rose Ltd used to despatch the goods to
the customer). Failure to take reasonable care that consequently
results in any damage to the returned item(s) will result
in Aliya Rose Ltd taking action to recover the cost of the
item(s) and associated expenses.
6.5 Aliya
Rose Ltd takes every care to ensure that goods leave the store
in excellent condition and faulty goods will never be delivered
knowingly. In those circumstances where an item is being returned
due to a fault a replacement item or full refund will be offered
to the customer. Only in this circumstance will the cost of
return be borne by Aliya Rose Ltd.
7.
Refunds
7.1 All
customers who exercise their right to cancel their contract
with Aliya Rose Ltd within 7 days and duly notify Aliya Rose
Ltd of their intention to do so will be entitled to receive
a refund for the cost of the item(s) purchased (Except in
those circumstances outlined in paragraph 5.2) and the cost
of original delivery (where all items from original order
have been returned). All refunds will be processed within
30 days following receipt of written confirmation from the
customer detailing their intention to cancel their contract.
7.2 Where
the cancellation of a contract consequently affects any discount
given to the customer by Aliya Rose Ltd the effect will be
to remove said discount and any refund will take account of
this necessary adjustment.
7.3 Where
the cancellation of a contract consequently affects any gift
offers given to the customer by Aliya Rose Ltd the effect
will be to remove said offer and the customer must return
any gift offer along with the item(s) being returned. Failure
to return the gift offer will result in the amount to be refunded
being adjusted accordingly.
